Terms and Conditions

You must be at least 18 years old and able to form a binding contract to use Perch. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate.

You are responsible for keeping your account credentials secure and for all activity that happens under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.

Perch helps you discover and compare parking areas. It is an informational service. Perch does not reserve parking, guarantee that any space is available, or sell parking on behalf of operators.

• Rates, operating hours, rules, and other details are largely community-sourced and may be inaccurate, incomplete, or out of date.
• Availability signals such as “usually busy” or “usually available” are estimates derived from aggregated activity, not real-time guarantees.
• Always confirm rates and rules with the parking operator. You are responsible for your own parking decisions and for following posted signage and local laws.

Perch depends on contributions from drivers. When you submit a parking spot, edit, rating, review, comment, or photo ("Content"), you grant Perch a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that Content within the Service and to use it to build aggregated parking data and insights.

You represent that, for any Content you submit:

• You own it or have the rights necessary to submit it and grant the license above.
• It does not infringe anyone’s intellectual property, privacy, or other rights.
• It is accurate to the best of your knowledge and not misleading.
• It is lawful and does not contain personal data of others without their consent.

You are solely responsible for your Content. Perch does not endorse and is not responsible for Content submitted by users.

You agree not to:

• Submit fake, duplicate, spam, or deliberately misleading parking spots, reviews, or photos.
• Manipulate ratings, helpful votes, reputation tiers, points, or moderation outcomes.
• Harass, threaten, or abuse other users, or post unlawful, hateful, or infringing content.
• Scrape, copy, or harvest data from the Service except as expressly permitted.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.

Contributions are subject to community moderation and may be hidden, removed, or reversed. Perch operates a reputation system (including contributor tiers and points) to weight trust and unlock features. Tiers, points, thresholds, and related mechanics may change at any time and confer no ownership, monetary value, or vested right.

Where we determine, at our reasonable discretion, that you have violated these Terms or harmed the community, we may take enforcement action proportionate to the conduct, including:

• Issuing a warning.
• Applying a temporary cooldown on contributions.
• Adjusting or removing points, or downgrading your tier.
• Hiding or removing Content.
• Suspending or terminating your account.

The Service is free to use and supported by advertising. We may display ads within the Service. Ads are intended to be non-intrusive and are governed by our Privacy Policy.

Perch, including its name, logo, software, and design, is owned by us and protected by applicable laws. These Terms do not grant you any right to use Perch branding without our prior written permission. Aside from the license you grant in Section 4, you retain ownership of your Content.

The Service relies on third-party providers, such as mapping and hosting services. Your use of those features may also be subject to the providers' own terms. We are not responsible for third-party services.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and the accuracy or availability of parking information.

To the maximum extent permitted by law, Perch will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from parking decisions, inaccurate community data, or unavailability of the Service.

You agree to indemnify and hold Perch harmless from claims arising out of your Content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or where necessary to protect the Service or its users.

These Terms are governed by the laws of the Republic of the Philippines. Any disputes will be subject to the jurisdiction of the courts of Metro Manila, without regard to conflict-of-law rules.

We may update these Terms from time to time. We will revise the date above, and material changes may also be communicated in the app or by email. Continued use after changes take effect means you accept the updated Terms.
